Fees charged by Panamanian Lawyers
In order to estimate or determine fees different to those listed here to be charged by lawyers
The following should be considered:
a. The importance of the legal service being provided.
b. The total amount the venture or business will represent
c. The financial and economical profits and the acceptance of such a possibility.
d. The novelty or difficulty of the legal matters at issue.
e. The experience of the lawyer and expertise on the legal matter on hand.
f. The fact that there is an opportunity cost that the lawyer will lose due to losing other legal consulting opportunities.
g. The financial well being of the client.
h. If the legal consulting services will be for a specified time or permanent in nature.
i. The possible contigency events that might take place while the legal process is taking place.
j. The time involved during the legal process.
k. Time involved with the participation of the lawyer in studying, investigating, and proposing the issue or process at hand-.
l. If the services rendered of the lawyer will be in or outside of the lawyer¨s premises.
m. The form and duration of payment of services rendered
ARTICLE 3 º sets a minimum fee rate of B/.250.00, except as set out in this Tariff, in any process where there is revocation of the power conferred or appointment of a new attorney.
Fees are determined as follows:
a.) 25% of what was agreed or as provided in this Tariff, if the revocation occurs after the power of attorney has been submitted and the suit has been filed.b
b.) About 40% of what was agreed or as provided in this Tariff, if the revocation occurs after the completion of the examination of evidence;
c.) 80% of what was agreed or as provided in this Tariff, if the revocation occurs after the completion the initial proceedings in the ordinary court or the first of the first stage of the proceedings if there is to is a second appeal stage.
d.) 100% of the agreement, if the reversal occurs in the appealing stage, unless there is a previously agreed substitution of lawyer and the existence of an agreement to pay fees according to the legal proceedings accomplished.
If there are in court or out of court or any other means by which the process is terminated, the lawyer will be paid in full or 100% of the fees previously agreed or what corresponds in fees according to this tariff. transactions medias or extra judicial court or any other means of termination of the trial, the attorney will be paid 100% of what was agreed or as provided in this Tariff.

36. THIRD PARAGRAPH: Those documents that involve several operations fees will be charged on the value of each operation, except for those that are included in the heading of this article, concerning the lending and if these are to be made by the same creditor.

FOURTH PARAGRAPH: In leases and other similar contracts. Fees will be calculated according to the length of time the contract will be in effect. In case of a lease or rental contract for indefinite time, fee calculations will be made as if it were a two year lease.

FIFTH PARAGRAPH Drafting documents related to Purchase/ Sale Contract of Urban Real Estate is subject to Condominium or horizontal t Property Regime the tariff that applies of $1 per 1000 according to the assessed value of such property with a minimum fee of $3000 per deed. SIXTH PARAGRAPH The full payment of mortgages and any other type of collateral will imply a $300 minimum fee, unless agreed on the contrary . MATTERS RELATED TO PROCEDURAL LAW (CIVIL – COMMERCIAL, BUSINESS)
1. EXECUTIVE PROCEEDINGS FORECLOSURE
a) Of a petty amount 25% of the value or amount litigated.
b) Of greater value up to $2,000.00 or 20% of the value.

NOTE: the above mentioned fees refer only to those proceedings that lead to the process of obtaining the transfer of rights and duties of the deceased person to the heirs, thus considering these proceedings not bound to ancillary suits of the inheritance or estate proceedings. But the ordinary proceedings that will follow concerning declaring void the will, feeding minors, goods to be inherited claims, litigious declarations of the heirs, etc.will be determined according as to those fees listed in the Previously mentioned Section 2..
b) When the shared possessions are awarded or allocated to the surviving spouse, the tariff that will apply are the ones established in the FAMILY AND MINORS PROCEEDINGS.
c) When in an inheritance proceedings there are several heirs represented by different lawyers, fees will be determined according to what or the amount that is inherited by each heir the lawyer represents.
d). In case the liability credits reach or exceed more than half the value of the assets fees will be increased proportionally from 25 to 50%.
PROCEEDINGS MADE BEFORE COMMERCE OR BUSINESS COURTS
The lawyer’s professional fee that will apply in business courts in according to the value and nature of the business on hand.
MARITIME PROCESSES
In maritime processes the tariff that will apply whenever possible the same tariff as approved for ordinary jurisdictions. In those court or out of court proceedings were it is necessary for the lawyer to intervene the tariff or fee that applies is $200 per hour
SPECIAL PROCESSES

The amount will be determined according to the value of the interested party’s rights.
2. Possessor’s processes.
This type of proceedings will be agreed on with the lawyer and client with a minimum of a $1000 fee taking into account the complexity of the case, the value of the goods, the work required, the special conditions required in terms of practice, professional specialty and the financial well being of the interested party..
3. Account submission- For these type of proceedings the same tariff as for Executive processes apply.

ARTICLE 5TH All matters and proceedings that are not listed in this tariff will be established or agreed upon or determined following whenever possible those proceedings that are analogous or similar in nature .
ARTICLE 6TH All matter or demand that is not regulated or in which the above mentioned FIFTH ARTICLE can not be applied, the Board of the Directors of the Panamanian Lawyer's guild or college is empowered to regulate on such matters, until a general assembly of lawyers is made to rule on this matter.
